High Court judge adjourns decision on Primus-EON Cap suit to Jan 31

KUALA LUMPUR: The High Court of Malaya at Kuala Lumpur has adjourned to Jan 31 the decision on the originating summons filed by Primus (Malaysia) Sdn Bhd against EON CAPITAL BHD [] following the EGM which was held on Sept 27, 2010.

EON Cap said on Monday, Jan 24, the adjournment was made after the judge had sought clarification on certain issues from the respective counsels.

To recap, on Oct 4, 2010, EON Cap said Primus (Malaysia) Sdn Bhd'' had filed an originating summons with the High Court as it sought relief from the court over several issues against the company.

Primus had sought a declaration that the motion for an adjournment of the EGM of the company held on Sept 27, 2010 was a valid motion.

It also sought to declare the chairman of the EGM decision not to put the motion for an adjournment of the EGM to a vote was unlawful.

Other relief included a declaration that the motion for the removal of the chairman of the EGM as a valid motion.

Primus had sought a declaration that the chairman's refusal to put the motion for his removal as the chairman of the EGM was unlawful; while all the proposed resolutions passed at the EGM were null and void.
